A BLOGGER... NI A PALOS PORQUE YA BORRÓ DEMASIADOS SITIOS DE AMIGOS...

Muchos sabrán a esta altura la situación que atraviesa hoy Taringa! Es por esto que queremos explicar los hechos con claridad como siempre lo hacemos, defendiendo nuestro trabajo y explicando el potencial daño que este proceso podría causar a la libertad en Internet en nuestro país.

Hacia 2009, La Cámara Argentina del Libro, las editoriales Astrea, La Ley, Rubinzal y Asociados, Ediciones de la Flor S.R.L., Ediciones La Rocca S.R.L., Editorial Universidad S.R.L., Gradi S.A. promovieron una denuncia contra Taringa! y otros sitios por supuesta infracción a la ley 11.723. La denuncia originalmente no prosperó en un procesamiento, y sólo pudo seguir su curso, luego de un recurso de apelación denegada.

Tal vez no todos nuestros usuarios sepan que significa este procesamiento, es por ello que nos parece bueno una breve reseña y así tener algo de claridad sobre lo mucho (o poco) que se está informando en este tema:El procesamiento es una instancia procesal que da por concluida la etapa de instrucción, de cara a la elevación a juicio de una causa penal. En términos generales el procesamiento indica que para los jueces existen elementos que justifican un juicio oral

¿Qué es lo que pasó hasta ahora?

Se nos intenta responsabilizar por ser titulares del medio, del instrumento, sin detenerse a reparar que no hemos cometido ninguna conducta penada por la ley. La Cámara confirma un procesamiento a partir de la presunta participación criminal en hechos penados por el art 72 de la ley 11.723, lo que equivale a sostener que como administradores de un sitio web somos garantes de la conducta seguida por nuestros millones de usuarios. Esto afirma el auto de procesamiento de primera instancia al intentar explicar el funcionamiento de este sitio web "Dicho accionar ha permitido que usuarios publicaran links autorizando la descarga de obras protegidas… sin que dicho accionar fuera evitado”. Se endilga la omisión en el control sin siquiera reparar si tal control es posible (esta es la verdadera discusión que debería estar planteándose en la justicia), y de allí se concluye en la participación criminal (si, leyeron bien, criminal) por omisión de una conducta penal que sólo puede ser cumplida por “comisión”, es decir llevándola adelante.

Bajo esta lógica se acusará también a los proveedores de Internet, a los buscadores, a los blogs, redes sociales, etc etc. sin cuya participación no habría delito posible. No es un dato menor, porque no es una discusión sobre Taringa! sino que abarca a todos los que participamos de internet y las redes sociales.

Es el Estado quien tiene a cargo la persecución de los autores de delitos, y es también a los titulares de derechos de autor a quienes la ley les da las herramientas para proteger sus obras. Como administradores de un sitio web no podemos reemplazar a uno ni a otros, no podemos investigar el destino final de cada uno de los 20.000 post diarios que recibimos, escrutando la inmensidad de Internet, para determinar eventualmente sobre la licitud o ilicitud de lo que sea que allí encontremos.

Este fallo deja entrever el escaso conocimiento y estudio que existe en nuestra justicia sobre Internet y el profundo impacto que la misma supone para el entramado de relaciones jurídicas de nuestro mundo actual. Es preciso que nuestros usuarios sepan que esperamos el Juicio para defendernos y defender aquello en lo que creemos. Lo que aquí se resuelva será de suma importancia para todos los que formamos parte de Internet.

Confiamos entonces que en esa oportunidad nuestra Justicia sabrá juzgarnos sobre la base de aquello que hayamos hecho y esté prohibido por las leyes, ya que está en riesgo el futuro de Internet tal como la conocemos hoy en día, el futuro de los contenidos, de los accesos y de todas las herramientas que usamos a diario para trabajar, para entretenernos, para informarnos.
