Suecia: condenan a los creadores del mayor sitio de intercambio de archivos

Se trata del portal "The Pirate Bay", por medio del que se descargan miles de películas y discos de música. Un tribunal los halló culpables de violar los derechos de autor y les dictó una pena de un año de prisión y una multa de 3.5 millones de dólares.

La Justicia sueca condenó esta mañana a un año de prisión a cuatro jóvenes acusados de violar los derechos de autor de miles de películas y discos musicales por fundar y desarrollar "The Pirate Bay", la mayor página web de intercambio de archivos del mundo.

Es la primera gran victoria judicial de las compañías de música y cine, que además pretenden ser indemnizadas por lo que consideran graves perjuicios sufridos durante los últimos años.

El Tribunal de Estocolmo impuso a los acusados una multa de 30 millones de coronas -unos 3,5 millones de dólares- inferior a la que pedían los abogados de las grandes multinacionales del cine y la música, presentes en el juicio, como Warner Bros., Columbia Pictures, Sony BMG, Universal y EMI, que pedían más de 11 millones de dólares.

Los acusados, que siguen declarándose inocentes, aseguran que su web hace lo mismo que Google, enlazar a otras webs y archivos. Además, argumentaron que en sus servidores informáticos no hay ningún material protegido por derechos de autor porque el intercambio no se produce desde sus ordenadores y ellos sólo ejercen de nexo entre otros internautas. Pero la Fiscalía -y los jueces esta mañana- consideraron que las actividades de Pirate Bay animan a violar los derechos de autor.

La pelea seguirá abierta. Un analista musical, Mark Mulligan, dijo a la prensa que no estaba seguro de la utilidad de esta sentencia: "cada vez que nos deshacemos de uno, aparece otro más grande. Napster se fue y después aparecieron muchos. El problema del intercambio de archivos continúa creciendo año tras año y es cada vez más difícil para la industria hacer algo al respecto".

Tras conocerse la sentencia, los cuatro acusados declararon en una rueda de prensa que la sentencia no es definitiva y que recurrirán para "obtener una victoria". Y volvieron sobre el argumento "Google". En el gigante buscador también se pueden encontrar cosas ilegales, pero eso no significa que Google cometa la ilegalidad.

FELLI - Historia

GIANFRANCO FELLI nació en el sur de Italia en 1955. Su familia se mudó al norte de Italia cuando tenía tres años. Gianfranco, el quinto de seis hermanos, creció escuchando todo tipo de música.

GIANFRANCO cantaba como vocalista invitado con muchas Bandas en la zona del LAGO COMO. En 1982 participó en una gira con la banda llamada "STUDIO 4" y comenzó su colaboración con ADRIANO CAGLIONI, tecladista de la Banda. En la misma época el FENOMENO ITALO comenzaba a crecer.

CAGLIONI y FELLI escribieron algunas canciones y se las ofrecieron al Sello Discográfico DISCOMAGIC. En 1983 Discomagic editó "DIAMOND IN THE NIGHT", que vendió 8000 copias sólo en Italia. La pista también se incluyó en la placa "MIX TOUR", compilación que vendió 36000 copias en Italia.

La canción "GREATEST MIND” fue lanzada al año siguiente, pero cierta tensión entre los compositores hizo que FELLI decidiera retirarse de la empresa.

Durante los años 1983/1984 FELLI se presentó junto a las Grandes Estrellas del ITALO-DISCO: DEN HARROW, JIMMY MCFOY & ALBERT ONE en las más importantes Discotecas de Italia (Piccadilly Strix de Sassuolo, Xenón de Florencia, en Follonica, Cecina, Biella, Crema, Varese, Sondrio, Como, etc). Fue un artista de la "NEW YORK AGENCY" de LUCA MILANI con artistas como ALPHAVILLE, NOVECENTO, J.D. JABER, JOE MARAN, RAF, SAVAGE y P.LION.

En Noviembre de 2006 CAGLIONI lo llamó FELLI para preguntarle si estaba interesado en participar en un proyecto con la Discográfica FLASHBACK RECORDS para grabar temas inéditos que habían creado en los años 80's. A FELLI le gustó mucho la idea de "Sumergirse en el pasado". FELLI actualmente vive en una colina sobre el Lago de Lugano con su adorable esposa y su hijo que quiere ser un cantante HIP-HOP/RAP.
